N2  - RésuméQuel est le point commun entre le transfert d’un joueur de football, la réalisation d’un tatouage et une consultation chez son médecin traitant ? Chacune de ces situations renferme un « contrat portant sur le corps humain ». En ce sens, la recherche révèle l’existence de nombreux contrats autorisés (contrat médical, contrat de travail…) ou interdits (gestation pour autrui, prostitution…) ainsi que leur appartenance à une même catégorie juridique, laquelle repose sur un régime commun et des règles spécifiques. De l’embryon au cadavre, sans oublier l’hypothèse du mineur et du majeur protégé, il s’agit de la première étude d’ensemble ayant abouti à une théorie générale du contrat portant sur le corps humain. Each of these situations contains a «contract concerning the human body». In this sense, the research reveals the existence of numerous authorised contracts (medical contract, employment contract…) or prohibited (surrogate motherhood, prostitution…) as well as their belonging to the same legal category, which is based on a common regime and specific rules. From the embryo to the cadaver, without forgetting the hypothesis of the minor and the protected adult, this is the first comprehensive study leading to a general theory of the contract concerning the human body.
