N2  - RÉSUMÉ : Notion essentielle, mais souvent insaisissable, l’autonomie s’est progressivement imposée dans le champ du droit, singulièrement dans le cadre de la prise en soin des personnes vulnérables. Principe armé et appliqué en Droit, elle n’en est pas moins fragilisée dans la pratique quotidienne. Deux types d’écueils la menacent lorsqu’elle est confrontée à la règle de droit. La tentation de légiférer, pour mieux la cerner et mieux la protéger, pourrait, paradoxalement l’enfermer dans une approche réductrice. Inversement, sa « magnification » pourrait ébranler le fragile équilibre de l’édifice juridique.ABSTRACT: An essential but often elusive notion, autonomy has gradually imposed itself in the field of law, particularly in the context of caring for the vulnerable. Principle armed and applied in law, it is nevertheless weakened in daily practice. There are two types of pitfalls when confronted with the rule of law. The temptation to legislate, in order to better define and protect it, could paradoxically lock it up in a reductive approach.
