N2  - RésuméEn imposant le consentement explicite et l’obligation d’information avant tout soin, la loi Kouchner a incontestablement fait évoluer la relation soignant-soigné vers plus d’autonomie du patient. Pour autant, la relation soignant-soigné comporte des particularités qui cadrent mal avec le droit des contrats. Ce texte a pour objectif d’examiner dans quelle mesure cette loi a modifié la nature de la relation soignant-soigné, d’en définir les limites et d’éclairer certains points qui posent fréquemment des problèmes d’interprétation.Mots-clésAutonomie – Consentement aux soins – ContratAbstractBy imposing patients’ formal explicit consent before any act of caring, the French law that passed in 2002 has changed the patient-caregiver relationship towards greater patients’ autonomy. However, this relationship includes features that do not fit well with contract.
