N2  - RésuméÀ l’heure de ses vingt ans, il paraît indispensable de repenser les équilibres qui composent le dispositif d’indemnisation amiable des accidents médicaux créé par la loi du 4 mars 2002. En effet, malgré un succès indéniable lié aux atouts que constituent son accessibilité, sa gratuité et sa rapidité par rapport aux procédures contentieuses, le dispositif amiable se trouve fragilisé par les évolutions qu’il doit affronter : professionnalisation du contentieux de la responsabilité médicale, manque d’experts, complexification des dossiers et judiciarisation du travail en commission.L’adaptation du dispositif à ces évolutions récentes suppose l’attribution de moyens permettant de remettre les CCI au sein du dispositif et de garantir à toutes les victimes un égal accès à une juste indemnisation.Mots-clésIndemnisation – Amiable – Victime – Accident médical – Commissions – CCI – ONIAM – CNAMedAbstractAs it turns 20, it seems essential to rethink the balance of the out-of-court medical accident compensation system created by the law of 4 March 2002.
