N2  - Avec l’article 18 de la loi n° 2021-1040 du 5 août 2021 relative à la gestion de la crise sanitaire, le législateur aligne le dispositif de réparation des préjudices imputables à la vaccination obligatoire contre le covid-19 sur le régime d’indemnisation des dommages liés aux vaccinations obligatoires déjà existantes pour les professionnels de santé. Cette mesure permet de faciliter l’indemnisation de préjudices survenus du fait de la vaccination obligatoire pour les professionnels de santé. Elle pose toutefois la question de l’indemnisation des professionnels qui se sont fait volontairement vacciner avant l’entrée en vigueur cette loi.By article 18 of the law n° 2021-1040 of August 5, 2021 relating to the management of the health crisis, the legislator aligns the system of compensation for damage attributable to compulsory vaccination against Covid-19 with the compensation system for damage linked to compulsory vaccinations that already exists for health professionals. This measure facilitates the compensation of damages arising from mandatory vaccination for health professionals. However, it raises the question of compensation for professionals who were voluntarily vaccinated before the law came into force.
