N2  - RésuméLa loi du 2 août 2021 ajoute dans le titre VII du livre I du Code civil, un chapitre V consacré spécialement à la filiation de l’enfant issu d’une procréation médicalement assistée (PMA) avec donneur. La nouveauté réside surtout dans les dispositions consacrées à la filiation de l’enfant d’un couple de femmes. Cette filiation est fondée sur une reconnaissance conjointe préalable devant notaire. Néanmoins, son opposabilité suppose une inscription à l’état civil pour laquelle il n’y a aucune obligation, ce qui laisse craindre l’établissement de filiations concurrentes et par conséquent de contentieux ultérieurs.
