N2  - Résumé : La valeur intrinsèque de la vie – y compris de celles qui seraient moins « parfaites » – constitue l’argument massue contre la recevabilité des actions pour préjudice de vie ou en « wrongful life ». Pourtant, le concept de préjudice est inextricablement lié à la notion de handicap et de ses différentes conceptions sociales, notion qui d’une question strictement médicale est passée à une problématique élargie où interviennent des déterminants biologiques, personnels et environnementaux. Le présent article reprend la vision englobante du handicap telle que promue par l’Organisation mondiale de la santé (OMS) afin d’apprécier la nature du préjudice admissible à indemnisation dans les actions en « wrongful life ». Un préjudice admissible peut ainsi être défini comme englobant tout problème de santé à l’origine de dysfonctionnements organiques susceptibles d’affecter les activités et la participation de l’individu dans sa relation avec son environnement.Abstract: The intrinsic value of life – including of those that would be less “perfect” – makes up the strongest argument against the admissibility of “wrongful life” lawsuits. However, the notion of injury is inextricably linked to that of disability as a social concept that evolves from a strictly medical to broader perspective involving biological, personal and environmental determinants. This study takes up the all-encompassing view of disability as advocated by the World Health Organization (WHO) in order to assess the nature of the injury eligible for compensation in “wrongful life” claims.Compensable injury can thus be defined as encompassing any health problem that causes organic dysfunctions likely to affect the activities and participation of the individual in his relationship with his environment.Mots-clés : préjudice de vie – handicap – indemnisationKeywords: wrongful life – disability – compensation
