N2  - RésuméLe revirement de la jurisprudence de la Cour suprême des États-Unis sur la question de l’avortement nous interroge sur ce qu’il est advenu depuis 1975, la reconnaissance de l’IVG dans notre droit positif, du statut de l’avortement. À l’inverse des États-Unis, où la garantie constitutionnelle s’est peu à peu réduite, il apparaît clairement que le droit positif français n’a cessé d’élargir la liberté reconnue en 1975 en ce qui est aujourd’hui un quasi-droit. Faut-il franchir une étape supplémentaire et conforter celui-ci en l’intégrant dans la Constitution ? Il nous semble qu’une telle approche inscrirait l’acquis de notre droit positif dans l’enjeu infernal d’une joute idéologique. Il nous paraît, en revanche, plus pertinent de réfléchir sur l’intérêt à reconnaître une certaine constitutionnalité aux droits procréatifs dans un équilibre qui reste cependant encore difficile à définir.Mots-clésIVG – Droits des femmes – Droits procréatifs – Constitution – Contexte internationalSummaryThe reversal of the US Supreme Court’s jurisprudence on the issue of abortion raises questions about what has happened to the status of abortion since 1975, when abortion was recognized in our positive law. In contrast to the United States, where the constitutional guarantee has been gradually reduced,it’s clear that French positive law has constantly expanded the freedom recognized in 1975 into what is now a quasi-right. Should we go one step further and strengthen this right by incorporating it into the Constitution? It seems to us that such an approach would place the acquis of our positive law at the infernal stake of an ideological contest. On the other hand, it seems to us more relevant to reflect on the interest in recognizing a certain constitutionality to procreative rights in a balance that is still difficult to define.Key wordsAbortion – Women’s rights – Reproductive rights – Constitution – International context
