N2  - RésuméLa LFSS 2023 introduit par voie légale une approche jusqu’alors portée par voie conventionnelle : le paiement de médicaments onéreux selon le résultat clinique rapporté en vie réelle. Le but est ici d’étaler le paiement de « médicaments de thérapie innovante » (au sens du droit européen) particulièrement onéreux, avec une cure initiale revendiquant un effet la vie durant. Le paiement étalé (linéaire, dégressif ?) est subordonné à la continuité de l’effet revendiqué pour le patient (comme un abonnement ou un crédit suspensif), et plafonné en cas d’arrêt anticipé. L’indicateur de performance est a priori simple, le recueil de données facilité, la mise en oeuvre attendue. Cette approche confirme la dynamique avec ici un véhicule inédit, car légal : vers l’achat public de résultats cliniques contractualisés, plutôt que de technologies de santé, pour maîtriser les prétentions commerciales.Mots-clésMédicament thérapie innovante – Contrat – Résultat – Prix – Paiement – Abonnement – Crédit suspensifAbstractIn order to control exponential expenses for certain innovative therapies, the french Parliament introduces in 2023 an approach hitherto taken by conventional way : the payment according to the clinical result reported in real life. Aim is to spread over time the payment of onerous so-called “advanced therapy medicinal products” that claim an initial cure and lifelong clinical effect for the patient. Payment is subject to the continuity of effect, and capped in the event of early termination.The key performance indicator is a priori simple, data reporting hence seems to be facilitated.Implementation is now expected.
