Dans la première hypothèse, l’applicationde la règle supplétive aux produits répondant à la définition de médicament par présentation conduiraà retenir une telle qualification, notamment lorsque celle de dispositif médical est exclue en l’absence demode d’action scientifiquement établi. In the first situation, the application of thesupplementary rule to products meeting the definition of medicinal product by presentation will leadto such a qualification being retained, particularly when that of a medical device is excluded in theabsence of a scientifically established mode of action.
