N2  - RésuméPar décret du 4 juin 2013, la SPFPL a été introduite dans le secteur de la pharmacie d’officine. Une décennie de mise en oeuvre a pu démontrer une forte appropriation de la profession d’un objet soulevant toutefois certaines questions en partie résolues par l’évolution du cadre réglementaire et tenant, d’une part, à l’intérêt fiscal de ce type de montage sociétaire et, d’autre part, à l’utilisation de la holding dans le cadre d’un exercice professionnel dans le respect des règles de détention capitalistique. La SPFPL demeure toutefois un objet délicat à mettre en oeuvre tant par la complexité des montages qui nécessitent une certaine prudence que par les incertitudes fiscales qui peuvent réduire les avantages recherchés.Mots-clésSPFPL – Fiscalité – Montages sociétairesAbstractBy decree of June 4, 2013, the SPFPL was introduced into the community pharmacy sector. A decade of implementation has demonstrated strong appropriation by the profession of an object, however raising certain questions partly resolved by the evolution of the regulatory framework and relating, on the one hand, to the fiscal interest of this type of corporate set-up and, on the other hand, the use of the holding company within the framework of a professional exercise in compliance with the rules of capital holding.
