N2  - RésuméLe carnet de santé est un élément clé du recueil et de la transmission des données de santé de l’enfantde sa naissance à sa majorité. L’ostéopathie est une profession bénéficiant d’une notoriété croissante dans le milieu de la santé. Aussi, la question de l’usage du carnet de santé par des ostéopathes devient indispensable dans l’intérêt des patients. Sa consultation ainsi que le fait d’y rédiger certaines observations méritent d’être appréhendés, et ce, dans la mesure où cet usage est conditionné à un cadrejuridique que cet article propose d’investiguer. L’analyse des différents éléments du droit positif et de la jurisprudence permet d’indiquer que, pour les ostéopathes, il existe à la fois des permissions et des devoirs de recourir au carnet de santé. Ils sont donc soumis à plusieurs enjeux consistant à respecter leur champ de compétences, tout en s’intégrant à la prise en charge pluridisciplinaire des enfants. Les arguments portent, d’une part, sur le rapport que les ostéopathes entretiennent juridiquement avec le milieu de la santé ainsi qu’avec la notion de secret professionnel et, d’autre part, sur l’intervention de premier recours et le respect des choix des usagers.Mots-clésOstéopathie – Carnet de santé – Secret – Premier recours – Responsabilité – ChoixAbstractThe health record is a key element in the collection and transmission of child health data from birth to adulthood. Osteopathy is a profession with a growing reputation in the health care sector. The question of the use of health records by osteopaths becomes a necessity for the patients. Consultation and drafting of some of the observations deserve to be apprehended, insofar as this use is conditioned by a framework that this article proposes to investigate. An analysis of the law and jurisprudence enable to indicate that, for osteopaths, there are both permissions and duties to use the health record. They are therefore subjectto several challenges consisting of respecting their field, while integrated into the multidisciplinary care of children. The arguments relate, on the one hand, to the legal relationship between osteopaths and the health care community as well as with the concept of professional secret and, on the other hand, on the intervention of first instance and compliance with the provisions of the user’s choice.KeywordsOsteopathy – Health Record – Secret – First instance – Responsability – Choice
