AB  - RésuméAnalysés à l’aune du droit des libertés fondamentales, les régimes juridiques du don et celui du « bébé-médicament » confirment le respect univoque porté à certains droits et libertés fondamentaux que l’on pourrait qualifier d’objectifs en ce qu’ils visent à protéger la personne en raison de son appartenance à l’espèce humaine. En revanche, le respect d’intérêts subjectifs centrés sur l’autonomie et la liberté des personnes concernées par le don – qu’il s’agisse du donneur, du receveur ou des membres du corps médical – demeure plus équivoque. On constate donc une prévalence de la logique de solidarité sur la logique d’autonomie.Mots-clésDon – Bébé-médicament – Droits et libertés fondamentaux – Solidarité – AutonomieAbstractAnalysed through the lens of fundamental rights law, the legal regimes of donation and that of the “saviour sibling” confirm the unequivocal respect afforded to certain fundamental rights and freedoms that could be qualified as objective, as they aim to protect individuals due to their belonging to the human species. In contrast, the respect for subjective interests centered on the autonomy and freedom of the individuals involved in the donation – whether the donor, the recipient, or medical personnel – remains more ambiguous.
