AB  - RésuméCette contribution analyse la procréation post mortem en droit italien en montrant comment un cadre juridique fondé sur des dispositions restrictives qui interdisent explicitement cette pratique permet néanmoins l’implantation post mortem d’un embryon. Elle met en lumière le rôle du consentement pour le lien de filiation, son caractère irrévocable, ainsi que la protection des droits de la femme et de l’enfant à naître. Deux décisions – de la Cour de cassation (2019) et de la Cour constitutionnelle (2023) – sont analysées : elles ont défini des questions juridiques essentielles pour ce sujet et sont expressément mentionnées dans les lignes directrices ministérielles de 2024. Ces dernières reconnaissent à la femme le droit exclusif de demander l’implantation d’un embryon, et ce, même après le décès de son partenaire ou à la suite d’une séparation. It examines the legal role played by consent in establishing parenthood, its irrevocability and the protection of the rights of both the woman and the future child. The article analyses two key judgments – one by the Court of Cassation (2019) and another by the Constitutional Court (2023) –, which clarified fundamental legal issues and are explicitly cited in the 2024 national clinical guidelines. These guidelines recognise the woman’s right to request the embryo transfer, even following the death or separation of her partner.
