AB  - Résumé : L’appréhension de l’état antérieur en matière de réparation du dommage corporel connaît une évolution profonde, marquée par un renversement méthodologique. Longtemps conçu comme une cause de non-imputabilité ou de réduction de l’indemnisation, l’état antérieur ne peut désormais produirecet effet que s’il entraînait déjà, avant le fait dommageable, une dégradation concrète des conditions de vie de la victime, ou s’il devait le faire à échéance certaine. La jurisprudence conduit ainsi à écarter les considérations purement étiologiques pour privilégier une analyse pragmatique des conséquences effectives. Dans ce nouveau cadre, l’état antérieur devient non plus un facteur d’exclusion, mais un fondement de l’imputabilité, permettant d’expliquer l’ampleur des séquelles constatées. Le doute profite désormais à la victime, la charge de la preuve du rattachement exclusif au tableau antérieur pesant sur le défendeur, consacrant une protection renforcée des personnes les plus fragiles.Mots-clés : État antérieur, imputabilité, réparation intégrale, charge de la preuveAbstract: The approach to pre-existing conditions in personal injury compensation has undergone a profound shift, marked by a methodological reversal. Long regarded as a ground for non-attribution or reduction of compensation, a pre-existing condition can now produce such effects only if it had already caused a concrete deterioration in the victim’s living conditions prior to the harmful event, or if suchdeterioration was certain to occur within a known timeframe. Case law thus moves away from purely etiological considerations in favour of a pragmatic assessment of actual consequences. Within this new framework, the pre-existing condition no longer excludes imputability but rather supports it, by explaining the extent of the observed sequelae. Doubt now benefits the victim, as the burden of proving theexclusive link to the prior condition rests with the defendant, thereby strengthening the protection afforded to the most vulnerable individuals.Keywords: Pre-existing condition, imputability, full compensation, burden of proof
