N2  - Abstract : Le Conseil d’État a récemment rendu son premier arrêt en section du contentieux sur la question des conflits d’intérêts dans le domaine de l’expertise sanitaire. L’analyse de la jurisprudence en la matière montre que le juge administratif se livre à une analyse fine et pragmatique des liens d’intérêts. Il se base pour cela sur la déclaration d’intérêts qu’ont l’obligation de renseigner les experts et qui joue un rôle déterminant mais non suffisant dans la preuve du conflit d’intérêts.The French Council of State has recently handed down an important judgement on the matter of conflicts of interest in the area of health expertise. The review of case law on this matter shows that the administrative judge undertakes a subtle and pragmatic assessment of interests.
