N2  - RésuméLe créateur de la norme en droit interne s’interroge sur les risques auxquels sont exposés les travailleurs qui produisent des nanomatériaux, les transforment ou les intègrent à des produits. En effet, la création exponentielle des nano-objets accroît le nombre de personnes en France susceptibles d’être exposées au travail alors que, parallèlement, la question de l’évaluation des risques les concernant reste entière dans un contexte d’incertitude ce qui complexifie la démarche de gestion des risques professionnels. La prévention actuelle a-t-elle pris la mesure de la caractéristique particulière de ces risques émergents ? On constate que l’état du droit positif et l’action de certains acteurs réalisant de la prévention au profit des travailleurs tant au niveau national que local permet à l’heure actuelle une régulation en dépit de l’absence de réglementation spécifique aux nanomatériaux. Cette régulation peut néanmoins paraître insuffisante et des perspectives d’évolution sont à rechercher tant dans la politique interne que dans la politique européenne.Mots-clésNanomatériaux – Risques professionnels – Prévention – Exposition – Identification – InformationAbstractFor the creator of the standard in internal Law some questions arise in connection with the risks that are incurred by the workers who manufacture nanomaterials, transform them or incorporate them into products.As a matter of fact, in France the spiraling creation of nano-objects increases the number of people who may be exposed at work, while at the same time the issue of assessing related risks remains, but in an environment of uncertainty which makes even more difficult the process to manage professional risks.Has the current way of preventing these emerging risks taken stock of their specific characteristics?We notice that positive Law, the way it stands now, the action of some of the actors who deal with prevention to the benefit of workers, both at national and local levels, enable control and that notwithstanding the absence of specific rules related to nanomaterials .Nevertheless this regulation may prove insufficient and we still need to look for improvements, both in internal and European policies.KeywordsNanomaterials – Occupational hazard– Prevention – Exposure – Identification – Information
