N2  - RésuméLes conditions de brevetabilité des inventions nanotechnologiques ne se distinguent pas de celles requises pour les autres inventions. Ainsi, la simple miniaturisation d’une structure ne constitue pas en soi un élément suffisant pour remplir la condition de l’activité inventive. De même, la sélection d’une plage de tailles parmi une plage plus large déjà connue n’est pas nécessairement nouvelle. La description de l’invention peut parfois poser problème en raison d’incertitudes terminologiques et de la forte évolutivité en la matière. The mere miniaturization of a structure is not by itself sufficient to meet the inventive step criterion. Similarly, a subrange of sizes within an already disclosed larger range might lack novelty. Moreover, terminological vagueness and rapid technological advances might impede a sufficient disclosure of the invention.
