N2  - RésuméIl n’existe pas en France de reconnaissance juridique d’un droit de propriété sur le corps humain ou ses éléments, à la différence de certaines législations qui ont pu reconnaître ce droit ou tenter de le mettre en place. Notre législation affirme des principes éthico-juridiques de protection du corps contre toute exploitation commerciale, à l’inverse de ce que peuvent parfois revendiquer les donneurs. En pratique, les éléments biologiques humains peuvent avoir une « biovaleur » dont un gain commercial pourrait être dégagé par les acteurs de la recherche scientifique. Face à ces considérations, il est nécessaire de réconcilier les approches entre respect de la non-patrimonialité et besoin de valorisation des éléments du corps, et d’envisager ainsi un système permettant à tous les acteurs de la recherche de pouvoir disposer des fruits résultant de l’exploitation du corps humain et de ses éléments.Mots-clésPropriété – Corps humain – Échantillons biologiques humains – Recherche scientifique – Biobanques – Valorisation – Démembrement de propriété – CommercialisationAbstractIn France, there is not a legal recognition of a right of ownership on the human body or its elements, in contrast to some legislations that recognized such a right, or to try to put it in place. Our legislation affirms some ethico-legal principles for the protection of the human body against commercial exploitation, in contrast to what some donors can claim. In practice, the human biological elements may have a “biovalue” whose commercial gain can be obtain by the actors of the scientific research.
