N2  - Résumé : Les réflexions philosophiques et médicales sur la folie de l’Antiquité au XIXe siècle ont permis la construction du droit de la santé mentale. L’élaboration de la première norme législative en 1838 a concilié mesure sanitaire et protection de l’ordre public. Les préoccupations humanistes ont nourri les débats sur la nécessité d’une réformation de ce droit singulier jusqu’à la fin du XIXe siècle.Abstract: The philosophical and medical considerations of the madness of antiquity in the nineteenth century allowed the construction of mental health law. The elaboration of the first legislative standard in 1838 conciliated sanitary measures and protection of public order.
