N2  - Résumé : Risque psychosocial majeur dans le secteur privé, le harcèlement moral est un phénomène qui se rattache aussi au secteur public. Le milieu hospitalier n’y échappe pas. Très tôt, le législateur a adopté une garantie légale des agents publics contre le harcèlement moral. Il s’agit de la protection fonctionnelle. Dans le paysage hospitalier, cette notion trouve une application dynamique. La cassation est l’occasion pour le juge de préciser le degré de son contrôle sur la combinaison du harcèlement moral et de la protection fonctionnelle des agents publics. La démarche probatoire du harcèlement moral sera le premier degré de contrôle, puis viendra celui de la qualification juridique du harcèlement moral consacré par les juges du fond. En tout état de cause, la mise en oeuvre d’une politique de prévention reste inévitable pour un établissement public de santé dans sa lutte contre le harcèlement moral. Abstract: Major psychosocial risk in the private sector, the moral harassment is also a phenomenon which links with the public sector. The hospital setting does not escape. Early on, the legislator adopted a legal guarantee of public officials against the moral harassment. It is about functional protection. In the medical landscape, this concept doesn’t find a dynamic application. The cassation is the opportunity for the judge to specify the degree of his control about the combination of moral harassment and of the public officials’ functional protection. The probation approach of moral harassment will be the first degree of control, and then will come the legal status of moral harassment dedicated by the trial judges.
