N2  - RésuméLa législation concernant la santé mentale dans une variété de juridictions, tant dans la tradition juridique de common law que dans différentes juridictions de tradition civiliste, prévoit la prise en compte d’un critère de dangerosité lorsqu’il est question de l’admission psychiatrique dite « involontaire » d’un patient. Comme en témoignent les travaux de différents observateurs du domaine de la santé mentale, telle la Haute Autorité de la santé française, l’évaluation du risque de dangerosité est bien souvent conçue de manière indissociée de l’évaluation du risque de violence future, exercice qualifié de l’un des plus difficiles auquel peut faire face un médecin psychiatre. Cette difficulté prend une acuité particulière lorsqu’il est question d’admission de patients mineurs.Mots-clésSanté mentale – Mineur – Admission psychiatrique – Volontaire – DangerositéAbstractIn a variety of jurisdiction, legislation regarding mental health provides that a criterion of dangerousness must be taken into account when considering the involuntary psychiatric commitment of an individual. In the first part of this article, the author will discuss the context leading to the adoption of the dangerousness criterion as a justification of an involuntary psychiatric commitment. In the second part, the author will identify epistemological obstables, notably the (in)capacity of psychiatry in establishing the futur risk of danagerousness in a patient. Finally, in part III, the author will evaluate the means by which the dangerousness criterion is applied to children and youth, while raising the risks of adopting an abnormality norm when pedopsychiatric evaluations of the state of children and youth take place.KeywordsMental health – Minor – Psychiatric admission – Voluntary – Dangerous nature
