N2  - RésuméLa loi du 4 mars 2002 relative aux droits des malades a institué un régime de responsabilité sans faute des établissements de santé au profit des victimes d’infections nosocomiales, à moins que la preuve d’une cause étrangère soit apportée. Plusieurs décisions rendues par le Conseil d’Etat permettent de mieux comprendre la mise en oeuvre de ce régime à l’égard des hôpitaux publics. La formulation elliptique du législateur a en effet laissé une marge de manoeuvre importante au juge. Celui-ci a d’abord forgé une présomption consistant à reconnaître un caractère nosocomial à une infection si cette dernière s’est déclarée au cours ou au décours d’une prise en charge à l’hôpital et n’était ni présente, ni en incubation au début de la prise en charge. Si l’hôpital public ne pouvait jusqu’alors en pratique échapper à sa responsabilité, un récent arrêt du Conseil d’Etat ouvre de nouvelles perspectives en ce sens.Mots-clésResponsabilité – Infections nosocomiales – Juge administratif – Présomption – Cause étrangèreAbstractThe law of the 4th of March 200  concerning patient’s rights has settled a fautless responsibility system of healthcare facility in favour of nosocomial disease’s victims, unless the extraenous event is prooved. Some decisions made by the Council of State allow to understand the application of the system for public healthcare facility. The elusive wording of the legislator has given an important wiggle room to the judge who has created a presumption which consists in the recognition of a nosocomial infection if it happens during or just after an hospital’s stay, without being present in incubation or in the beginning of the treatment.
