N2  - RésuméQuand on aborde la question de l’information en droit de la santé, plusieurs choses viennent à l’esprit. Le droit à l’information du patient comme droit fondamental et donc, en conséquence l’obligation d’information qui pèse sur les professionnels. Le partage de l’information médicale dans le cadre d’une prise en charge coordonnée. L’information des familles sur l’état et le suivi de leur proche. L’information des autorités dans certaines situations posant problème. L’information du grand public, qu’il s’agisse de l’accès à la connaissance par l’usager ou encore de l’information du grand public en matière de scandale sanitaire. Dans ce contexte, l’information sera synonyme de transparence. Enfin, qui dit « information » dit potentiellement « valeur » : valeur scientifique mais, pourquoi pas, valeur marchande.La notion d’information en droit de la santé est donc une notion polymorphe aux enjeux multiples. Ceux-ci vont d’ailleurs différer selon que l’on aborde la question de l’information orale, écrite, dématérialisée ou non. D’une manière générale, l’enjeu principal restera celui de la protection de l’information.L’objet de cette journée d’études sera de faire échanger médecins, professionnels de santé et juristes sur ce sujet riche afin de tenter d’aborder la question de l’information en droit de la santé dans tous ses états.Mots-clésIntelligence artificielle - Big data - Données de santé - TIC - Confidentialité - Entourage - Patient - AutoritésAbstractTalking about information in Health Law involves several notions : the fundamental right of patients to be informed, or the duty to inform the medical practitioners owe to their patients ; the sharing of medical information in a global and coordinated patient care ; keep the relatives informed about the patient’s health status. There is also the case of disclosing medical confidentiality to inform the authoritieson certain situations, or else, informing general audience about potential sanitary scandals. In that particular context, information can be equated to transparency. One may also consider information through its scientific value and though its economic value.Medical information is a polymorphous notion raising several challenges, the main being : how to protect the patients’information.
