N2  - RésuméLe projet de loi relatif à la bioéthique adopté par l’Assemblée nationale le 15 octobre 2019 propose de modifier le Code civil, principalement afin de l’adapter à l’élargissement de l’AMP aux couples de femmes. L’AMP avec tiers donneur ferait ainsi l’objet d’un chapitre spécial au sein du Titre VII du Livre Ier au sein duquel, au-delà de l’évolution de certaines dispositions relatives au consentement à l’AMP, seraient notamment prévues les règles régissant l’établissement du lien de filiation entre l’enfant et les deux femmes organisées autour d’une reconnaissance conjointe anticipée. Dans la perspective d’une telle évolution de la filiation par le sang permettant à l’enfant d’avoir deux mères, l’ajout d’une disposition au sein du Titre préliminaire, ce qui est relativement inédit, est également prévu afin de garantir l’égalité entre tous les enfants.Mots-clésFiliation – Assistance médicale à la procréation – Don – Homosexualité – EnfantAbstractThe bioethics bill adopted by the National Assembly on October 15, 2019 proposes to amend the Civil Code, mainly in order to adapt it to the extension of the GPA to couples of women. The MPA with third-party donor would thus be the subject of a special chapter within Title VII of Book I in which, beyond the development of certain provisions relating to consent to the MPA, the following would in particular be provided for: rules governing the establishment of parentage between the child and the two women organized around early joint recognition.
