N2  - RésuméLa mise en danger d’autrui est un délit juridiquement exigeant, principalement adapté aux situations accidentogènes, mais sans réalisation de l’accident. Sa mise en oeuvre dans les affaires de « santé-environnement » ne va donc pas de soi, car au-delà de l’existence ou non d’une loi ou d’un règlement contraignant(e) délibérément violé(e) se pose le problème scientifico-juridique de la démonstration de l’exposition à un risque (et non d’un risque d’exposition), pas simplement porteur d’une dimension délétère mais potentiellement de nature à pouvoir provoquer la mort d’un être humain (autrui) ou altérer gravement sa santé ou son intégrité physique. La thématique des incinérateurs d’ordures ménagères anciennes générations est une des rares à l’origine de procédures pénales pour mise en danger d’autrui, versus « santé-environnement », ayant prospéré.AbstractEndangering others is a legally demanding offense, mainly adapted to accident situations but without the occurrence of an accident. Its implementation in “health-environment” cases is therefore not self-evident because beyond the existence or otherwise of a legally binding law or regulation that is deliberately violated, the scientific problem arises. Of the demonstration of exposure to a risk (and not a risk of exposure) not simply carrying a deleterious dimension but potentially of a nature to be able to cause the death of a human being (others) or to seriously deteriorate his health or physical integrity.
