Résumé
L’obligation de secret professionnel, qui trouve sa source dans le fondement même de la relation médicale reposant sur une confiance réciproque entre le professionnel et le patient, constitue une obligation générale et absolue fermement protégée par les juges et étendue par la loi du 26 janvier 2016 relative à la modernisation de notre système de santé aux professionnels et aux établissements du secteur social et médico-social. Comme tout principe, cette obligation connaît des dérogations. Certaines d’entre elles sont instituées dans l’intérêt public, d’autres dans l’intérêt du patient ou de ses ayants droit, sachant que parfois les deux intérêts sont combinés.

Abstract
The obligation of professional secrecy, which is rooted in the foundation of the medical relationship based on mutual trust between the professional and the patient is a general and absolute obligation firmly protected by the judges and extended by the law of 2016 on the modernization of french health system professionals and the social sector and medico-social. As every principle, this duty deals with dispensations. Some of them are established in public interest when some other are established in patient or his beneficiaries interest’s, knowing that sometimes, both interests are linked.
