Cannabis à usage médical en France : des défis juridiques à relever

Résumé

Le cannabis, après avoir longtemps été stigmatisé et exclu du domaine médical, fait son grand retour en médecine dans de nombreux pays étrangers. En contraste avec le régime répressif des plus rigoureux applicable aux stupéfiants en France, les premiers pas vers un futur accès au cannabis à usage médical ont également été réalisés. Cette volonté d’évolution semble avoir été initiée par la mise en place de l’expérimentation du cannabis à usage médical sur le territoire national en 2020. Dès lors, la France se trouve actuellement à un carrefour crucial dans la détermination de son approche vis-à-vis de cet usage. De nombreux points attendent encore d’être éclaircis pour défaire les idées préconçues et garantir les droits des patients. Ainsi, il est essentiel de répondre à divers défis permettant un équilibre entre les potentiels thérapeutiques du cannabis et les risques associés à son utilisation. Pour y parvenir, une réflexion autour de la définition et de l’efficience du cadre juridique du cannabis médical s’avère opportune.

Abstract

Cannabis, after having long been stigmatized and excluded from the medical field, is making a significant return to medicine in many foreign countries. In contrast to the strict repressive regime applied to narcotics in France, initial steps towards future access to medical cannabis have also been taken. This shift in approach seems to have been initiated with the implementation of the medical cannabis experiment in the country in 2020. Since then, France currently finds itself at a crucial crossroads in determining its stance on this usage. Many issues remain to be clarified in order to dispel preconceived ideas and protect patients’ rights. Therefore, it is essential to address various challenges in order to strike a balance between the therapeutic potential of cannabis and the risks associated with its use. To achieve this, reflection on the definition and efficiency of the legal framework for medical cannabis is necessary.
