Résumé
La loi du 4 mars 2002 a donné une assise législative à de nombreux droits du patient, qui étaient en général issus de la jurisprudence. Elle poursuit deux objectifs principaux : assurer la protection du patient, envisagé comme une personne vulnérable, et permettre l’expression de son autonomie, en tant qu’acteur à part entière de la relation de soins. Il s’agit, vingt ans après, de s’interroger sur la réalité de l’application concrète de ces droits individuels du patient.
Asbtract
The law of March 4, 2002 gave a legislative basis to many patients’ rights, generally derived from case law. It has two main objectives: to ensure the protection of the patient, considered as a vulnerable person, and to allow the expression of his autonomy, as a full actor in the care relationship. Twenty years later, we need to look at the reality of the application of these individual rights of the patient.
