Condamnation d’un directeur d’Ehpad pour homicide involontaire

Résumé : Un directeur d’Ehpad, ainsi que l’établissement en tant que personne morale, ont été condamnés pour homicide involontaire à la suite du décès d’une résidente. Cette dernière avait chuté suite au défaut de manipulation d’un lève-personne par une aide-soignante, elle-même relaxée. Alors qu’un appel a été interjeté, le présent article propose une analyse de cette décision de première instance.

Abstract: A nursing home director, as well as the establishment as a legal entity, were convicted of involuntary manslaughter following the death of a resident. The resident had fallen due to the improper handling of a patient lift by a nursing assistant, who was herself acquitted. While an appeal has been filed, this article offers an analysis of this first-instance decision.
