Abstract
The law of March 4, 2002, established the principle of compensation through national solidarity in cases of no-fault medical accidents, iatrogenic conditions, or nosocomial infections (therapeutic risks), subject to strict conditions. Case law, both civil and administrative, has gradually adopted an interpretation of these conditions that favors patients, leading to improved compensation. This trend can be seen in the easier granting of compensation for nosocomial infections and an expansion of the scope of therapeutic risk.
