Résumé
À l’heure où les instances européennes s’interrogent sur l’usage de médicaments en dehors des conditions prévues par leur autorisation de mise sur le marché, le cas de la France illustre la difficulté de concilier les intérêts de santé publique et les responsabilités des pouvoirs publics et acteurs de santé.
Le régime des recommandations temporaires d’utilisation (RTU) en illustre l’enjeu, amenant le Conseil d’État à se prononcer sur les contours de cette réglementation et, encore très récemment dans l’affaire Baclofène©, sur la responsabilité des médecins et pharmaciens nonobstant le rôle accru des pouvoirs publics.

Abstract
The enhanced responsibilities of the public authorities and healthcare stakeholders in the Temporary Use Recommendations’ regulations
At a time when the European authorities’attention is focusing on the use of medicines outside the conditions laid down under their marketing authorisation, the case of France illustrates the difficulty of reconciling public health interests and the responsibilities of public authorities and healthcare stakeholders. The Temporary Use Recommendations’regulations (TUR) highlight the issues at stake,
leading the Conseil d’État to rule on the outlines of this regulation and, more recently in the Baclofène© case, on the responsibilities of the doctors and pharmacists despite the enhanced role of the public authorities.
