Quel avenir pour les certificats complémentaires de protection pour de nouvelles applications thérapeutiques en Europe après l’arrêt Santen ?
Résumé
Dans son arrêt Santen du 9 juillet 2020, la Cour de Justice de l’Union européenne met fin aux débats provoqués par sa jurisprudence antérieure en rejetant la protection de nouvelles applications thérapeutiques de médicaments connus par des certificats complémentaires de protection. Ce revirement, qui fragilise un pan entier de l’industrie pharmaceutique, pourrait présager une prise en main de la question par la Commission.

Abstract
In its Santen ruling of 9 July 2020, the Court of Justice of the European Union puts an end to the debates provoked by its previous case law by rejecting the protection of new therapeutic applications of known medicinal products by supplementary protection certificates. This reversal, which weakens an entire sector of the pharmaceutical industry, could herald the Commission’s handling of the issue.
