Résumé
Issue d’un riche travail de réflexion et de concertation entamé dès le drame du sang contaminé, la loi du 4 mars 2002 a suivi un processus de fabrication inédit mis au service d’un objectif ambitieux : restaurer la confiance dans le système de santé en posant les bases de la démocratie sanitaire comme clef de refondation. Le texte, qui porte la marque des grands enjeux de l’époque, est aussi porté par une aspiration visant à inscrire la santé dans le champ des droits de l’homme et à en donner une perspective unifiée.

Abstract
The law of 4 March 2002 is the result of a long process of reflection and consultation that began after the contaminated blood tragedy. It was drawn up through an unprecedented democratic process that served an ambitious objective: to restore confidence in the health system by laying the foundations of health democracy as the key to its refoundation. The text, which bears the mark of the major issues of the time, is also driven by an aspiration to include health in the field of human rights and to give it a
unified perspective.
