Résumé
La notion de consentement prend en droit une double signification. La première, qui est celle du droit des contrats, renvoie à l’expression d’une volonté libre et éclairée qui engage et soumet à un certain nombre d’obligations. La deuxième, retenue par le droit des personnes humaines et des libertés fondamentales, correspond à la permission donnée de franchir un interdit essentiel, situé au coeur des impératifs de sauvegarde de la dignité humaine, celui de ne pas porter atteinte à l’intégrité de la personne. C’est à la première forme que renvoient les admissions en soins psychiatriques sans consentement. De telles admissions relèvent de voies particulières d’entrée en soins ; elles n’ont ni pour objet ni pour effet de permettre la mise en oeuvre de traitements forcés et ne conduisent pas à priver le patient de son libre consentement aux soins.

Abstract
The notion of consent has a dual meaning in law. The first, which is that of contract law, refers to the expression of a free and informed will that commits and subjects to a certain number of obligations.The second, retained by fundamental freedoms, corresponds to the permission given to cross an essential prohibition, situated at the heart of the imperatives of safeguarding human dignity, that of not infringing on the integrity of the person. It is to the first form that admissions to psychiatric care without consent refer. Such admissions are particular ways of entering care ; they have neither the purpose nor the effect of allowing the implementation of forced treatment and do not lead to depriving the patient of his free consent to care.
