Résumé
Les directives anticipées expriment la volonté de leur auteur tenant aux conditions de la poursuite, de la limitation, de l’arrêt ou du refus de traitement au risque de décès. Depuis la loi n° 2016-87 du 2 février 2016, elles s’imposent au médecin, qui peut cependant les écarter lorsqu’elles apparaissent manifestement inappropriées ou non conformes à la situation médicale de leur auteur. Dans sa décision du 10 novembre 2022, le Conseil constitutionnel a jugé que cette exception à la force obligatoire des directives anticipées est conforme aux droits que garantit la constitution. Les motifs de cette décision suscitent une explication critique.

Abstract
Advance directives express the wishes of their author regarding the conditions for continuing, limiting,stopping or refusing treatment at the risk of death. Since Law 2016-87 of 2 February 2016, they are binding on the doctor, who may, however, set them aside if they appear manifestly inappropriate or not in keeping with the medical situation of their author. In its decision of 10 November 2022, the Constitutional Council ruled that this exception to the binding nature of advance directives complies with the rights guaranteed by the Constitution. The reasons for this decision call for a critical explanation.
