Principe de sécurité juridique et droit souple : la Commission de la transparence peut-elle faire évoluer sa doctrine ?
Résumé
Dans ses conclusions, le rapporteur public Mathieu Le Coq livre son analyse des rapports entre droit souple et sécurité juridique. Il conclut dans la présente affaire à ce que soit écarté le moyen tiré de la méconnaissance du principe de sécurité juridique en ce que la Commission de la transparence aurait modifié, sans mesures transitoires, sa doctrine d’évaluation des médicaments antidiabétiques. Ces conclusions nous offrent l’occasion de revenir sur l’intégration des actes de la HAS dans l’ordre juridique ainsi que sur l’étendue du principe de sécurité juridique.

Abstract
In his conclusions, public rapporteur Mathieu Le Coq provides his analysis of the links between soft law and legal certainty. In the present case, he concludes that the argument based on violation of the principle of legal certainty, because the “Commission de la transparence” (Transparency Committee) would have modified, without transitional measures, its doctrine of evaluation of antidiabetic drugs, should be rejected. These conclusions give us the opportunity to revisit the integration of the acts of the French High Authority for Health (HAS) into the legal order as well as the extent of the principle of legal certainty.
