L’approche raisonnée de la notion d’équipe de soins dans la protection du secret médical du patient (CE, 5e ch., 4 juillet 2025, n° 491701, inédit)

Résumé

Dans son arrêt du 4 juillet 2025, le Conseil d’État précise les contours de la notion « [d’]équipe de soins », laquelle fonde la présomption de consentement du patient au partage de ses informations médicales dans le cadre de sa prise en charge. La haute juridiction administrative retient à cette occasion une interprétation raisonnée de cette notion, afin de garantir l’effectivité de la protection du secret médical dans le contexte hospitalier.

Abstract

In its decision of 4 July 2025, the Council of State clarified the scope of the concept of “care team”, which forms the basis for the presumption of patient consent to the sharing of their medical information in the context of their care. On this occasion, the high administrative court adopted a restrictive interpretation of this concept in order to guarantee the effective protection of medical confidentiality in a hospital setting.
