The evolution of international protection of pharmaceutical intellectual property and its impact on public health
Cet article propose une vue d’ensemble de l’évolution de la protection inter- nationale de la propriété intellectuelle pharmaceutique. Il explore l’impact des accords internationaux ADPIC et ADPIC-PLUS sur la santé publique. Ces accords ont progressi- vement permis à la Chine d’améliorer son système de lois et de règlements concernant la protection de la propriété intellectuelle. Ces progrès ne semblent toutefois pas suffisants, notamment au vu des exigences des États-Unis et de l’UE. Il est nécessaire, pour la Chine, de trouver un équilibre dans la protection de la MTC. Ces pratiques, au vu de leurs parti- cularités, pourraient souffrir de l’application stricte des règles de propriété intellectuelle. C’est pourquoi il apparaît important de s’inspirer des accords internationaux préexistants tout en se détachant du carcan occidental de la protection de la propriété intellectuelle.
This paper overviews the evolution of international protection of pharma- ceutical intellectual property, explores the impact of TRIPS and the TRIPS-plus on public health, and makes suggestions for China’s options for level of IP protection.
