Abstract
By imposing patients’ formal explicit consent before any act of caring, the French law that passed in 2002 has changed the patient-caregiver relationship towards greater patients’ autonomy. However, this relationship includes features that do not fit well with contract. The purpose of this text is to examine the extent to which this law has changed the nature of the patient-caregiver relationship, to define its limits and to clarify some points that frequently raise interpretation issues.
