Résumé
La réflexion éthique dans le domaine de la santé a souvent comme socle les quatre grands principes éthiques de l’OMS. Dans le domaine spécifique de la psychiatrie et des mesures de soins sans consentement, faire le choix d’un acte éthique confronte le psychiatre à la clarification et à l’exploration approfondie de la situation clinique singulière à laquelle il est confronté, mais également à une interrogation sur ses propres processus décisionnels. Le médecin est ainsi amené, dans certaines situations, à se substituer au malade pour empêcher qu’un processus morbide n’amène ce dernier à réaliser des actes qui lui échappent et qui lui seraient préjudiciables ou qui mettraient l’ordre public en danger. La lourdeur psychologique de cette décision de privation de liberté ramène le psychiatre à sa responsabilité de protection bienveillante des patients, même si cela heurte ses convictions, qui ne sont certainement pas d’enfermer les malades. C’est ici l’éthique conséquentialiste qui guidera le médecin dans sa décision, l’amenant ainsi à la réinterroger à chaque évolution clinique.

Abstract
Ethical reflection in the field of health is often based on the four major ethical principles of the World
Health Organization. In the specific field of psychiatry and care measures without consent, choosing
an ethical act confronts the psychiatrist with the clarification and in-depth exploration of the unique
clinical situation with which he is confronted, but also with a questioning on its own decision-making
processes. The doctor is thus required, in certain situations, to take the place of the patient to prevent
a morbid process from leading the latter to carry out acts which escape his control and which would
be detrimental to him or which would endanger public order. The psychological heaviness of this
decision to deprive of liberty brings the psychiatrist back to his responsibility of caring protection of
patients, even if this conflicts with his convictions, which are certainly not to lock up the sick. It is here
consequentialist ethics which will guide the doctor in his decision, thus leading him to re-examine it
with each clinical evolution.
