Regards juridiques sur l’asile d’Arkham – The Elizabeth Arkham Asylum for the Criminally Insane

Résumé

L’asile Elizabeth-Arkham pour les malades mentaux criminels constitue une figure emblématique de l’univers de Gotham City dans les comics Batman. Sa visite virtuelle par un juriste permet de mettre l’accent sur certains points saillants du droit hospitalier, certes en l’occurrence celui des établissements plutôt privés que publics. Par sa proximité avec l’univers carcéral, la sphère asilaire en partage les problématiques tenant au respect des droits et libertés des individus, de leur dignité. Ce pouvoir et cette contribution à l’oeuvre collective de santé publique justifient le contrôle, par l’État notamment, de ces lieux de soin si particuliers. Tous ces éléments constituent autant d’occasions de rendre hommage aux travaux du regretté Vincent Vioujas.

Abstract

The Elizabeth Arkham Asylum for the Criminally Insane is an emblematic figure in the Gotham City universe of the Batman comics. A virtual tour of it with a jurist highlights certain salient points of hospital law, in this case that of private rather than public institutions. Due to its proximity to the prison world, the asylum sphere shares its issues relating to respect for the rights and freedoms of individuals, their dignity. This power and this contribution to the collective work of public health justify the control, particularly by the State, of these very special places of care. All these elements constitute opportunities to pay tribute to the work of the late Vincent Vioujas.
