La recherche du consentement est un principe fondamental textuellement consacré. Il prévoit que le détenu, comme tout malade, doit être informé des actes de diagnostic, de prévention et de soins qui lui sont prodigués. Cependant, l’enfermement en fait un principe d’application délicat. La recherche du consentement aux soins s’inscrit dans un mouvement plus large d’autonomisation de la personne incarcérée qui vise à atténuer « l’emprise institutionnelle ». Il existe donc deux situations, soit le soin est une partie de la peine et il nécessite le consentement de la personne incarcérée, soit le soin devient une nécessité absolue pour le malade, comme pour la société, et le consentement ne peut plus être obtenu.
